1. INTRODUCTION

Welcome to Captain11, a premier fantasy sports platform owned and operated by Tablor Technologies Private Limited, a company incorporated under the laws of India. Captain11 allows users to participate in skill-based online fantasy contests across various sports. These Terms and Conditions ("Terms"), along with our Privacy Policy, Cookie Policy, and other associated policies, govern your access to and use of the platform ("Platform").

By registering, accessing, or using Captain11, you agree to abide by these Terms and comply with all applicable laws and regulations. If you do not agree, please do not use the Platform.

2. ELIGIBILITY

To participate in any Paid Contest on Captain11:

  1. You must be at least 18 years of age.
  2. You must be a resident of India.
  3. You must register using a valid Indian mobile number.

Restricted States:

Paid Contests are prohibited in:

  • Andhra Pradesh
  • Assam
  • Nagaland
  • Sikkim
  • Telangana

By participating, you confirm you are not a resident of the above states. Misrepresentation to circumvent these restrictions is a violation of Indian law and these Terms.

3. TAXATION & GST

GST on Deposits:

  • As per current tax laws, 28% GST is applicable on every deposit made into your Unutilised Account.
  • GST paid will be visible in your "My Transactions" section and invoiced accordingly.

TDS on Winnings:

  • In line with the Income Tax Act, 1961, 30% TDS is deducted on Net Winnings (NW) on every withdrawal.
  • If no withdrawal is made, TDS will still apply on NW as of 31st March.

Net Winnings (NW) Calculation:

  • First Withdrawal NW = A - (B + C)
  • Subsequent Withdrawals NW = A - (B + C + E)
  • Year-End NW = (A + D) - (B + C + E)

Where:

  • A = Total amount withdrawn
  • B = Non-taxable deposits
  • C = Opening balance at start of financial year
  • D = Balance at financial year end
  • E = NW already taxed in earlier withdrawals

TDS certificates will be issued. You are responsible for any other applicable taxes (e.g., income tax, gift tax).

4. REFUNDS

We will refund any amount remaining in your Unutilised Account:

  • If your account is suspended due to platform error
  • Upon instruction from a regulatory authority
  • If a contest is abandoned under our Terms

Refunds are subject to verification and processing timelines. Refunds may incur standard processing fees.

5. USER FUNDS & ESCROW

  • You authorize Captain11 to appoint a third-party trustee/escrow agent to securely hold your funds.
  • Deposits are used solely for participation in contests or related services.
  • Captain11 does not hold any title to funds or the Prize Money Pool, except under lawful instructions from authorities.

6. LEGAL COMPLIANCE

  • You agree to comply with all Applicable Laws, including the Information Technology Act, 2000 and Digital Personal Data Protection Act, 2023 (DPDP Act).
  • You agree not to use Captain11 to commit any illegal acts or compromise platform security.

7. PRIVACY POLICY

Data Collected:

  • Personal details (Name, Phone, Email, PAN, Bank info)
  • Usage data (IP address, location, device info)

Use of Data:

  • Identity and age verification
  • Payment processing
  • Fraud prevention and legal compliance

Data Sharing:

  • With authorized partners (e.g., payment processors)
  • With government authorities when required by law

User Rights:

Under the DPDP Act, users have the right to:

  • Access and correct data
  • Request deletion of data
  • Raise grievances within 15 working days

Children's Data:

  • Captain11 does not knowingly collect data from individuals under 18 years.
  • Verifiable parental consent is required if such data is inadvertently collected.

Data Storage in India:

  • All user data is stored and processed exclusively within India.
  • No personal data is transferred outside India.

10. GOVERNING LAW & DISPUTE RESOLUTION

  • These Terms are governed by the laws of India.
  • All disputes shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
  • Disputes may be resolved through arbitration under the Arbitration and Conciliation Act, 1996.
